ITD Letter: Data Requests Must Go Through a Public Records Request

Summary

ITD District 1's letter telling the No Huetter Bypass Group that the technical and analytical data it requested for the Rathdrum Prairie Area Transportation Study goes beyond what is typically shared in public engagement, and that this and future requests must go through ITD's Public Records Request process.

Why it matters: ITD said the study data the group asked for must go through a public records request, which can carry charges, instead of being shared with the working group.

Dear Brian,

ITD has received your letters and inquiries regarding the Rathdrum Prairie Area Planning Study and we appreciate your engagement and interest in the Community Working Group and the Rathdrum Prairie Area Transportation Study.

The level of technical and analytical data you requested goes beyond what is typically distributed as part of the public engagement process. For that reason, for this and future requests for specific detailed technical data related to the Rathdrum Prairie Area Transportation Study, a public records request will need to be processed through the Idaho Transportation Department’s Public Records Request process. This will ensure that your request is properly documented, reviewed, and responded to in accordance with ITD policy and state law. Completing a Public Records Request will also make sure that you have access to all the project information you are requesting.

To submit a Public Records Request:

  1. Visit itd.idaho.gov.
  2. In the red box labeled “Inside ITD,” click “Public Records Request.” You might need to scroll down to find the “Inside ITD” box.
  3. Select “Submit a Records Request” and then select “Public Records Request.”
  4. You will then be prompted to enter your account email and password, or if you don’t have an account to create one by clicking on “New User.” This secure account allows you to request, and receive, any project information electronically that is not protected by State Law.

When filling out your request, please be as clear and specific as possible about the information you want. ITD staff can only submit the public records that you list in your request. Being specific helps ensure that you receive all the information that you are requesting, without your incurring additional charges, if applicable.

The Public Records Request process is designed to make sure all citizens have equal and transparent access to public information, and we want to ensure that you receive a complete and accurate response.

Please note that if you’re seeking specific data owned or managed by KMPO, that is not already available in the project records through ITD, a separate public records request will need to be submitted directly to the KMPO office for their proprietary information. The direct number to KMPO is (208) 930-4164, and they can help you with their specific public records request process.
